The GDPR is Now in Effect!

In case you somehow missed it, the GDPR took effect as of yesterday, May 25, 2018.

As you likely already know, the GDPR (i.e. the General Data Protection Regulation) is an EU regulation that brings greater data privacy protection to EU citizens.

But the GDPR doesn’t just apply to businesses within the EU. It also applies to anyone doing business with, or holding data for, citizens of the EU—as explained in this Financial Post article.

For most of my Canadian clients, the GDPR isn’t causing much consternation as you might think. After all, they’ve already had to fall in line with our own Canadian laws: the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada’s Anti-Spam Law (CASL).

However, it’s important to understand that there are some differences between these laws and the GDPR.

For example, the GDPR has provisions for data portability that are not present in Canadian law. It’s also stricter on consent.

In contrast to my Canadian clients, many of my U.S. clients have been scrambling to figure out what actions to take (and not take).
